Permanent Residency Pathway for Subclass 457 and 482 Visa Holders with occupations on the Short-Term Skilled Occupation List (STSOL)
Starting 1 July this year, subclass 482 (Temporary Skill Shortage) and subclass 457 (Temporary Work Skilled) visa holders with occupations on the Short-Term Skilled Occupation List (STSOL) will have an option to apply for an Employer Nomination Scheme (ENS) visa via the Temporary Residence Transitional (TRT) stream.
To be eligible, you must be able to show:
457 Visa Holders (Temporary Work Skilled)
On 18 April 2017, you held a subclass 457 visa or had a pending 457 visa that was subsequently granted.
You have worked in your nominated occupation for your sponsoring employer for at least three years of the last four years while holding your subclass 457 visa.
482 Visa Holders (Temporary Skill Shortage)
You are a subclass 482 visa holder.
You have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021.
In the course of your application, you have an employer actively and lawfully operating a business in Australia.
You have worked in your nominated occupation for your sponsoring employer for at least three years of the last four years while holding your subclass 482 visa.
Whether their nominated occupation is on the Medium & Long-Term Strategic Skills List (MLTSSL), the Short-Term Skilled Occupation List (STSOL) or the Regional Occupation List (ROL), 482 and 457 visa holders in the short-term stream will now have a pathway option for permanent residency. Applicants who meet the main criteria still need to meet the English, health and character requirements for the permanent visa application.
This PR pathway option is relevant for the applications under these Employer-sponsored programs:
Subclass 187 (Regional Sponsored Migration Scheme) visa
This new legislative instrument provides a pathway to employer-sponsored permanent residency for an additional cohort for subclass 457 and 482 visa holders throughout the Temporary Residence Transition stream of the employer nominated/sponsored schemes as per Minister Hawke announced last 25 November.
