400 Visa Temporary Work (Short Stay Specialist)

400 Visa Overview 

The Temporary Work visa subclass 400 is a short-term visa for highly specialised skilled professionals valid for up to 6 months (depending on the circumstances). This is suitable for highly skilled migrants with specialised skills, knowledge or experience in professions or occupations that aren’t generally available in Australia. The 400 visa allows you to carry out short-term, non-ongoing work within Australia and in limited circumstances, you may participate in an activity or work relating to Australia’s interests. The 400 visa does not require business sponsorship, but a letter of support from an Australian business is generally an essential document for any 400 visa application. You must also be outside of Australia to apply for the 400 visa.

Benefits

The 400 visa will allow you to work in a highly specialised job for up to 6 months. You can include family members to accompany you during your stay. Please note that they will not be allowed to work or study in Australia except for a language training program

Eligibility and Requirements

The Australian business or overseas employer may need to show that they have tried to find Australian workers to do the work first, as this visa cannot be granted if it affects employment or training opportunities for Australian citizens or permanent residents.

There are two eligibility streams for the Subclass 400 Visa:

The Highly Specialised Work Stream

  • It must be demonstrated that the work in question is highly specialised and that the applicant holds the skills required to carry out this work.

  • The work must not be ongoing in nature. This means that the activity is likely to be completed within 3 months. 

  • A stay of up to 6 months may be considered if there is a strong business case. 

  • Workers must not be rotated through the same position. If the position requires to be filled for periods longer than 6 months, you should consider a TSS 482 visa

Australia’s Interest Stream

This would typically involve demonstrating compelling circumstances affecting Australia’s interests such as:

  • Major disasters or emergencies.

  • Impact on Australia’s diplomatic, trade or business interests.

  • Significant benefit due to the person’s contribution

How it works

  • Be invited by an Australian company that needs to demonstrate they have a need for specific specialist skills to assist in the fulfilment of a project or contract in Australia. 

  • The visa applicant has to demonstrate that he/she has highly specialised skills, knowledge or experience which cannot reasonably be found in the Australian labour market that can assist the Australian business in fulfilling a project or contract. 

  • The work should be likely to be completed within a continuous period of six months or less. 

  • There should also be a benefit to Australian employees through the transfer of skills by the overseas employer to Australian employees. 

Processing time: 

The Department of Immigration and Border Protection’s service standard for processing Subclass 400 Visa ranges from 5 working days up to 1 month.

You will not need to pay this application charge if you are:

  • coming to Australia to act as a representative of a foreign government.

  • listed in a legislative instrument (your inviting organisation will tell you if this applies to you).
