117 Visa Orphan Relative(Offshore)

Visa Overview 

Subclass 117 Visa also known as the Orphan Relative Visa (Offshore) allows those children who are single and have lost their parents or have no one to take care of them, to come to Australia and live with their relatives. Successful applicants will be entitled to live in Australia permanently and will be able to work and study in Australia. The orphan should be financed by a qualified relative who is either residing in the country or is a permanent member of the country.

Eligibility and Requirements

To be eligible to apply for the 117 Visa, the child must:

  • Be offshore when applying for this visa

  • Be sponsored by an eligible Australian relative.

    • An eligible relative may include child’s siblings, grandparents, aunt and uncle or the current spouse or de facto partner of the child’s relative

    • The relative must be an Australian citizen, permanent resident, or an eligible New Zealand citizen

    • The sponsor must have consented by the court to allow the child to leave his/her home country and come over to Australia

  • Be under 18 years old

  • Be single and an orphan in a case that his/her parent cannot care for due the following reason:

    • Deceased

    • Permanently incapable of caring the child

    • Can’t be found

  • Meet the health requirement

  • Meet the character requirement

  • The visa will be granted if it is in the best knowledge of the child

How it Works

Step 1: Prepare all the necessary documents, such as: identity documents, travel documents, evidence that the child has no parents who can care for him/her, child’s relationship evidence to relatives, character documents.

Step 2: Lodge the 117 Visa Application online.

Step 3: Update the Department when there are changes in contact details, addresses and passports.

Step 4: Applicants will be informed by writing from the Department about the visa outcome. If the application has been refused, information such as the reason why it was refused and if there’s a chance for a review of the decision will be included in the letter.
