Are These Changes a Sign of Bigger Shifts in Immigration Policy?

Australia’s immigration system is constantly evolving, and 2024 brings several important changes. Whether you're managing a visa application, exploring work opportunities, or planning a working holiday, these updates could impact you. Let’s walk through the key changes you need to be aware of.

Transition from AAT to the Administrative Review Tribunal (ART)

As of 14 October 2024, the Administrative Appeals Tribunal (AAT) has been replaced by the Administrative Review Tribunal (ART). Here’s what you need to know:

  • What happens to your existing AAT case?

    • If you submitted your AAT application on or before 13 October 2024, you don’t need to take any further action. Your case has been automatically transferred to the new ART, and you’ll be notified if anything else is required.Manage your case as usual: If you applied online, you can continue using the same login details to track and manage your case in the new system.

  • Are previous AAT decisions still valid?

    • Yes, all decisions made by the AAT remain final and valid, unless there’s a pending appeal in court. The ART will not review cases already decided by the AAT.

ANZSCO to OSCA: A New Classification System for Occupations

Starting on 6 December 2024, the Australian and New Zealand Standard Classification of Occupations (ANZSCO) will be replaced in Australia by the Occupation Standard Classification for Australia (OSCA).

  • Why is this change happening?
Australia and New Zealand’s labour markets have grown apart since ANZSCO was introduced in 2006. As a result, Australia has developed its own classification system to better reflect its local workforce.

    • What’s driving the change?

      1. Australia’s labour market has become increasingly different from New Zealand’s.

      2. New Zealand couldn’t participate in recent updates to ANZSCO, so Australia proceeded with its own review.

      3. Both countries have tailored their systems to better meet local needs and stakeholder feedback.

What happens to ANZSCO?
While OSCA will be the primary classification system in Australia, ANZSCO will still be available on the ABS website. OSCA is designed to offer a more accurate reflection of Australia’s current labour market.

New Work and Holiday Visa Agreement with the Philippines

Australia and the Philippines have entered into a new Work and Holiday (subclass 462) visa arrangement, allowing up to 200 young people from each country to live, work, and explore for up to 12 months in each other’s country.

  • When will this start?
The program is not yet live, as both governments are finalising the necessary administrative arrangements. The Department will announce the official start date and provide more information on the application process soon.

How to apply:
Filipino passport holders will need to obtain a Letter of Concurrence (LoC) from their government, while Australians will be given further instructions on how to apply. Keep an eye on official channels for updates.

Are These Changes a Sign of Bigger Shifts in Immigration Policy?

The recent updates could indicate broader shifts in Australia's immigration policies. These changes reflect the government's effort to streamline processes, better reflect the evolving workforce, and cater to the needs of both the domestic and global labour market.

What could this mean for you?

If you’re considering applying for a visa, or if you’re already in the process, these updates could impact your eligibility or the requirements you need to meet. The switch to the new Occupation Standard Classification for Australia (OSCA) in particular may affect skilled visa categories, as occupation lists and classifications play a crucial role in visa eligibility.
