  • There are 4 main criteria for an Australian partner visa. All of which requires sufficient and strong evidence to support. Here are the main criteria:

    Nature of household
    The domestic arrangement and shared responsibilities within the household.

    Nature of Commitment
    The knowledge of each other’s personal circumstances and long-term intention in their relationship

    Financial Aspects
    Joint ownership assets such as joint bank accounts and co-owned properties.

    Social Context
    The couple’s relationship is accepted and recognised by common friends and family members.

  • For the two-step permanent residency pathway application (temporary to permanent visa), the current processing time according to the Australian Department of Home Affairs takes between 23-36 months to process.

  • To qualify for a partner visa, you and your partner must be legally married or in a de facto relationship for at least 12 months.

  • You must have an eligible sponsor who is also your partner or de facto partner. If you are onshore, you may initially apply for a temporary 820 visa which will have its 2nd step towards permanent 801 visa. If you are outside Australia, you must initially apply for a temporary 309 visa which will have its 2nd step towards permanent 100 visa.

  • While it’s not completely difficult to get approved, understanding and providing necessary evidence to have a strong application is important. Currently, the refusal rates for Australian partner visa applications are higher.

  • Failure to prove the 4 main criteria for a partner visa will end towards a visa refusal. Insufficient evidence to support the information provided to prove a genuine and committed relationship is the most common cause for a refusal of a partner visa application.
