Overview
A two-step permanent residency partner visa pathway for people who are currently outside Australia. The initial visa subclass 309 is a temporary visa that allows the applicant to enter and stay in Australia while waiting for the decision on the permanent visa subclass 100 visa application.
Eligibility Criteria
At least 18 years old
Currently residing in Australia at the time of application and at the time of decision
Hold a valid visa which does not have an 8503 no further stay condition attached.
Student visa; or
Visitor visa; or
Working Holiday visa
If applicant and sponsor is married, the marriage must be valid under the Australian law
If applicant and sponsor are in de-facto, it must be proven ongoing for at least 12 months
Sponsor Criteria
An Australian citizen, Australian permanent resident or an eligible New Zealand citizen
Sponsor is not granted a partner visa within the last 5 years
Have not sponsored an person on a partner visa application in the last 5 years
Have not sponsored a partner or prospective visa by someone else in the last 5 years

Initially have a valid temporary visa while waiting for the permanent residency visa decision

Overview
A 5 year temporary visa for a family member of a New Zealand citizen. There is no direct permanent residency pathway for this visa. However, it can be reapplied after it has expired.
Eligibility Criteria
Applicant must not be a New Zealand citizen
An eligible family member of a New Zealand citizen
Spouse or de facto partner
Child or step child
Under the age of 18 years old or
Above the age of 18 years old but under the age of 23 years old who is financially dependent on the sponsor or their spouse or de facto partner
Above the age of 23 years old and are dependent on the sponsor or the sponsor’s partner due to physical disability that deters them from earning a living to support themselves
Grandchild or step-grandchild who is a dependent of a child who meet one of the criteria above

Failure to provide evidence that the relationship is genuine and continuing
Providing misleading or false information

For the two-step permanent residency pathway application (temporary to permanent visa), the current processing time according to the Australian Department of Home Affairs takes between 23-36 months to process.

To qualify for a partner visa, you and your partner must be legally married or in a de facto relationship for at least 12 months.

You must have an eligible sponsor who is also your partner or de facto partner. If you are onshore, you may initially apply for a temporary 820 visa which will have its 2nd step towards permanent 801 visa. If you are outside Australia, you must initially apply for a temporary 309 visa which will have its 2nd step towards permanent 100 visa.
