New Investment Framework for Significant Investor Visa (SIV) and Premium Investor Visa (PIV)

The new complying investment framework for the Significant Investor Visa (SIV) and Premium Investor Visa (PIV) has been announced by the Department of Immigration and Border Protection (DIBP). The new investment framework is expected to be implemented from 1st of July 2015. Below are the highlights of the new investment framework:
•    Besides state and territory governments, Austrade will also become a nominator for the SIV and sole nominator for the PIV
•    Compliance will now prevent indirect investment in residential real estate through managed funds as this area is already attracting large capital flows
Under the new framework, the 5 million investment funds over 4 years for SIV applicants must now include:
•    A minimum of $500,000 to be directed to an eligible Australian venture capital or growth private equity fund(s) investing in start-up and small private companies. This figure is expected to increase to $1 million for new applications within 2 years depending on the market response
•    A minimum of $1.5 million to be directed to eligible managed fund(s) or listed investment companies (LICS) that invest in emerging companies listed on the Australian Securities Exchange (ASX)
•    The “balancing investment” of up to $3 million to be directed in managed fund(s) or LICs that invest in a combination of eligible assets (10% limit on residential real estate)
The new PIV is expected to be introduced on the 1st of July 2015:
•    This programme is targeting a limited amount of highly talented and entrepreneurial individuals
•    This programme will offer an accelerated 12 month pathway to permanent residency with a $15 million investment threshold
•    Invitation can only be issued by the Australian government to potential applicants nominated by Austrade
•    The programme is expected to be rolled out next year
