Can you sponsor a foreign worker? – 457 Business Sponsor Introduction

As a diverse nation, Australia has been welcoming foreign workers to serve its residents with diverse backgrounds.  In order for a business to employ foreign workers, an Australian business is required by Department of Immigration and Border Protection (DIBP) to obtain a business sponsorship, before nominating a foreign worker. What are the criteria of being an eligible sponsor and nomination?

Legal and continuous operation Australia
To prove the business has the capability to provide a job to foreign worker, the business must prove it has been operating in Australia for a period of time. 

Training Benchmark
A specified policy implemented by DIBP to protect Australian local workers. The business is required to have devoted certain business resource in providing trainings to its existing local workers, at time of applying for sponsorship.

Labour Market Testing
DIBP cannot accept the 457 program to jeopardise the employment opportunity towards local workers. The business is required to demonstrate its difficulty to source local skilled workers, and such skills shortage is affecting the business in a way that has to be solved by employing foreign workers.

Temporary Skilled Migration Income Threshold (TSMIT)
Even though the foreign worker is employed, their terms and conditions must not be anywhere inequivalent to local workers. Their conditions must not be treated unequally, and vice versa.
